In Oregon it is allowed to request “arrests that did not result in a conviction” along with any convictions. Every employer asks this on application forms. Oregon State requests state if an arrest or conviction is left off, the applicant will not be eligible for the employment they are seeking.
I am working with a client who had an arrest/dismissal dated 1976 for “crimes against children L&L, FEL. For serveral years this has not been a problem. Recently it came across a records check and he was fired from his job for falsifying information. Now it shows up on every check. We got the records clearance app but it says “your arrest reamins on the record.” So now what? Is he doomed as long as he is seeking employment in Oregon? He has lived here over 25 years and has a family he is trying to provide for.
